The Website is operated by ExperienceFlow.AI (“ExperienceFlow,” “we,” “us,” or “our”), a company headquartered in California, USA.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.

We have tried to keep these Terms clear and practical so you can quickly understand how you may use our Website and content.

Important: These Terms apply only to your use of the Website and any free online resources accessible from it. Your use of ExperienceFlow’s paid products and services as a customer is governed by separate written agreements (such as a master services agreement, order form, or data processing agreement), which will prevail in case of any conflict.

1. Eligibility and Business Use

The Website is intended for business and professional users interested in ExperienceFlow and its solutions.

By using the Website, you represent and warrant that:

  • You are at least the age of majority in your jurisdiction;
  • You have the legal power and authority to enter into these Terms; and
  • If you access the Website on behalf of a company or other legal entity, you are authorized to bind that entity, and “you” in these Terms refers to both you individually and that entity.

If you do not meet these requirements, you must not use the Website.

2. Other Applicable Terms (Privacy & Cookies)
Your use of the Website is also subject to:

  • Our Privacy Policy, which explains how we collect, use, and protect personal information; and

3. Scope of the Website and Services Covered
The Website includes, among other things:

  • General information about ExperienceFlow and our enterprise AI solutions;

  • Online forms for contact, demo requests, partner inquiries, support requests, and similar business interactions;
  • A partner section, where channel and technology partners can learn about partnership opportunities and submit inquiries; and
  • A developing marketplace section, where ExperienceFlow and selected partners may list models, AI solutions, or related offerings, and where users may be redirected to partnersites or environments to access those offerings.

These Terms cover your use of the Website and these Website-based experiences only. They do not grant you any right to use ExperienceFlow’s paid products or services beyond what is made available on the Website, nor do they govern any contractual relationship with ExperienceFlow as a paying customer or partner.

4. Intellectual Property and License to Use the Website

 

4.1 ExperienceFlow Content

Unless otherwise indicated, all content and materials on the Website, including text, graphics, logos, icons, images, videos, audio clips, software, documentation, infographics, and page layouts (collectively, “ExperienceFlow Content”), are owned by ExperienceFlow or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and view the Website and ExperienceFlow Content; and
  • Download or print reasonable portions of ExperienceFlow Content solely for your internal business purposes (such as evaluating ExperienceFlow solutions),

Provided that you:

  • Do not remove or alter any proprietary notices;
  • Do not modify the ExperienceFlow Content; and
  • Do not copy, reproduce, or distribute ExperienceFlow Content beyond what is reasonably necessary for internal evaluation.

You may not use ExperienceFlow’s names, logos, or trademarks without our prior written permission.

4.2 Your Content

If you submit, upload, or otherwise provide any information, data, text, or materials to us through the Website (for example, via forms, partner submissions, or marketplace-related requests) (“Your Content”), you:

  • Represent that you have all necessary rights to submit Your Content; and
  • Grant ExperienceFlow a non-exclusive, worldwide, royalty-free license to use, reproduce, store, display, and process Your Content as reasonably necessary to operate the Website, respond to your requests, evaluate partnership or marketplace opportunities, and provide the relevant services you requested.

We do not claim ownership of Your Content. You are responsible for ensuring that Your Content is accurate, lawful, and does not infringe the rights of others.

You must not provide through the Website any highly sensitive personal data (such as health information, payment card data, government-issued identification numbers, or other special categories of personal data) unless we expressly ask for it in a secure manner.

4.3 AI-Generated Content and Informational Nature

From time to time, we may provide demo experiences, interactive tools, or AI-generated outputs (such as insights, summaries, or recommendations) through or linked from the Website.

Any such AI-generated content or outputs are provided for general informational and illustrative purposes only and:

  • Are not guaranteed to be accurate, complete, or up-to-date;
  • Should not be relied upon as professional advice (legal, financial, medical, or otherwise); and
  • Are used at your own risk.

You remain responsible for reviewing and validating any AI-generated content before relying on it for business decisions.

Our goal is to give you helpful insights and experiences, but we also want to be transparent about their limitations so you can use them thoughtfully in your own context.

5. Marketplace and Partner Content

5.1 ExperienceFlow Marketplace

The Website may include a marketplace or similar section where:

  • ExperienceFlow may list its own models, AI solutions, templates, or connectors; and
  • Selected partners may list their models, solutions, connectors, or related offerings (“Marketplace Offerings”).

Marketplace Offerings may be:

  • Hosted directly by ExperienceFlow; and/or
  • Hosted by or accessed through third-party partner websites or environments.

Your use of any Marketplace Offering may be subject to additional terms and conditions, including:

  • Partner-specific terms;
  • Separate licenses or subscription agreements; and/or
  • Additional privacy or security notices.

 

5.2 Partner Content and Links

The Website and marketplace may contain:

  • Third-party content (including descriptions, documentation, logos, and links) provided by channel or technology partners; and
  • Links or integrations that redirect you to partner websites, applications, or services.

We do not control and are not responsible for:

  • The content, practices, or policies of partner websites or services;
  • The availability, quality, or security of partner-hosted Marketplace Offerings; or
  • Any transactions or relationships you enter into directly with partners.

Your access to and use of partner websites and services is at your own risk and is governed by the partner’s own terms and policies, not these Terms.

6. Accounts and Security

Some parts of the Website (for example, partner portals, marketplace dashboards, or other restricted areas) may allow or require you to create an account or log in.

If you create an account:

  • You must provide accurate and complete information and keep it up to date.  
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • You must promptly notify us at xflowmarketing@experienceflow.ai of any unauthorized use of your account or any other security breach.

We reserve the right to suspend, disable, or terminate any account that we believe has been compromised, used in violation of these Terms, or otherwise poses a risk to the security or integrity of the Website, our systems, or other users.

7. Acceptable Use

You agree that you will not

  1. Use the Website for any unlawful, harmful, fraudulent, or malicious purpose;
  2. Attempt to gain unauthorized access to any part of the Website, accounts, or systems;
  3. Interfere with or disrupt the operation of the Website or the servers or networks used to make the Website available;
  4. Use any automated system (such as bots, scrapers, or crawlers) to access the Website, except for standard search engine indexing or tools expressly permitted by ExperienceFlow;
  5. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software used in the Website, except to  the extent that such activity is expressly permitted by applicable law;
  6. Use the Website to transmit any viruses, malware, or other harmful code;
  7. Misrepresent your identity or affiliation with any person or organization;
  8. Use the Website to upload or transmit any content that is unlawful, infringing, defamatory, or otherwise objectionable; or
  9. Use any information or data obtained from the Website to build, train, or improve any machine learning or AI model without ExperienceFlow’s prior written consent, except where such use is clearly permitted by an open-source or other explicit license provided by ExperienceFlow.

We reserve the right (but have no obligation) to monitor, restrict, or terminate access to the Website if we believe you have violated these Terms.

8. No Professional Advice

Content on the Website is provided for general informational and marketing purposes only. It does not constitute:

  • Legal advice;
  • Financial or investment advice;
  • Medical or health advice; or
  • Any other professional advice.

9. Disclaimers

To the fullest extent permitted by applicable law:

If applicable law does not allow the exclusion of certain warranties, some of the above exclusions may not apply to you. In such cases, any implied warranties will be limited to the minimum extent required by law.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • ExperienceFlow and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Website, any ExperienceFlow Content, or any linked partner/marketplace content, even if we have been advised of the possibility of such damages.
  • In no event will the total aggregate liability of ExperienceFlow and its affiliates arising out of or related to these Terms or your use of the Website exceed one hundred U.S. dollars (USD 100).

Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law (for example, liability for fraud or fraudulent misrepresentation).

 

11. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless ExperienceFlow and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  • Your use of the Website;
  • Your violation of these Terms; or
  • Your violation of any applicable law or the rights of any third party.

12. International Use, Export Controls, and Sanctions

The Website may be accessed from countries around the world. We do not represent that the Website or any ExperienceFlow Content is appropriate or available in every jurisdiction.

If you access the Website from outside the United States:

  • You do so on your own initiative and are responsible for compliance with local laws; and

14. Governing Law and Dispute Resolution

These Terms and your use of the Website are governed by the laws of the State of California, without regard to its conflict of laws principles.

You and ExperienceFlow agree that any disputes arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

If you are located in a jurisdiction that does not permit this choice of law or forum, these provisions will apply to the maximum extent permitted by local law.

15. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and ExperienceFlow with respect to your use of the Website.
  • Severability: If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.
